Fascinating subject! I assumed context would be paramount. I also assumed agreeing officially to any sort of contract would require more than just a "thumb(s) up". And that kiss emoji... I kind of assumed it was intended as a peck on the cheek kind of thing. But watching this video caused me re-evaluate that. I'm pretty sure there are no "sloppy tongue kiss" emojis out there. Officer Arsenault, you may have just, in the least, saved me from a really embarrassing moment! (Thankfully, I'm quite selective whom I send that emoji to.)

As mentioned similar to a handshake in years past. I believe the case where the thumbs up was considered binding was also because there were numerous previous instances where the people involved agreed to terms that way. So if someone had threatened me in the past perhaps that boxing glove would be considered a threat. It’s interesting to think about stuff like this.

The courts need to give themselves a shake. A handshake shouldn't be a binding agreement until documents have been signed. This isn't the 50's and 60's anymore. Too many thieves and con men now for that. Letting an emoji equal a signed legal document is absolutely ridiculous! Having said that, violence emojis should be considered harmless until they aren't. @officer Arsenault, Thanks for posting this. It is a very important point and I agree that it is quite concerning. As a former legal professional, I am concerned that if emojis are being taken as binding in the courts, then what about the authenticity of the author? What does the thumbs up mean? Acknowledgment or acceptance? Both words start with the same letter but have different meanings, subject to the intent of the author and the interpretation of the reader. I'd be happy to get in touch with you so we can collaborate further. What is the best email to connect with you? Best regards!

Excellent and informative video! May I also add how people should behave? When police signal you to pull over, do it immediately. Put the car in park, driver side windows down, interior light on if it's dark, turn the engine off, and keep your hands on the wheel. When they ask for your documents, tell them where it is (glove box or in your pocket) and ask if you can reach for them. Don't just reach for them. No sudden movements. Don't argue with them, don't exit the vehicle unless they tell you to. Leave when they say you can leave. Be polite and professional with them, and they will extend the same courtesy to you.

Sometimes my kids send text messages, and I always respond with heart-eye or kissing emojis. These emojis come from my heart, even if I'm in a bad mood. Every mom does this despite their mood. If they send a funny one, even if I'm upset or angry, I send a laughing-with-tears emoji. It’s funny, but I can't laugh even if it’s funny when I'm upset. When I was in a relationship, they would send hugging or kissing emojis, and I would do the same even if I was angry or upset. I think that's normal. However, regarding other emojis, I never use even the thumbs-up emoji. If I don't understand something, I send a thinking emoji. If you regularly use certain emojis, they stay on your phone, so you don't have to search for them. On my phone, I only have smile, heart-eye, kissing, angry, red, blue, white hearts and appreciation emojis, which I regularly send to my kids or use to comment on people's posts on Instagram or yutube.

iirc, in the case of that farmer the buyer said that because the farmer had agree to contracts via text in the past, the judge ruled that the emoji constituted a contractual agreement in this case, but wouldn't necessarily extend to every instance. So, the best way to avoid this is just never use emojis with business partners or in legal correspondence, but if you can't manage that, just never accept a contract via text. Always do it in person, by phone, or with a proper signature via e-mail or fax.
